For a long time in Kenya customary law marriage was viewed as a “lesser” type of marriage. With the Marriage Act in place, the customary marriage accords a spouse the same rights as a christian or civil marriage. The regulations on Islamic marriage are still being prepared. Hindu marriages are also recognised in Law. All these marriages have a certificate issued.
It is now easy for a spouse to ascertain that they are married without having constantly to swear affidavits. However, Islam and Customary marriages are polygamous. Only Civil, Christian and Hindu marriages are monogamous.
Some of the advantages of registering your customary marriages include;
i) Illegitimacy and discouraging underage marriages
ii) No more secret marriages
iii) Spouses are recognised as next of kin; in succession and all other benefits that accrue to a spouse
iv) Parentage of children is more clear. Children have a right to lineage.
v)Clarity that customary marriage is polygamous and each spouse has rights
